COS Ballot Measures – 2B & 2C, transfer of parkland to private entities

There are two Colorado Springs questions on the November ballot (Colorado Springs residents only) pertaining to the transfer or sale of Park land from public ownership to private entities. These measures would apply to the majority of Colorado Springs parks and open space with some minor exceptions (less than 2 acres or 5% of a park’s land). Medicine Wheel Trail Advocates urges everyone to educate themselves on this very important question and Vote! Mail in ballots were mailed out on October 9.

Ballot Measure 2B and 2C

Ballot measure 2B requires a supermajority vote of city council (7-2) plus voter approval to transfer parkland.

Ballot measure 2C only requires a supermajority vote of city council (7-2).

FAQs:

  • What if both questions pass? The measure with the most “yes” votes will take effect.
  • Will one or the other question be selected for certain?  No, if neither measure reaches 50% approval there will be no change to the status quo.
  • Why are there two questions on the ballot? Both questions were referred by city council, with a different mix of council members supporting each one.

A “yes” vote supports requiring a supermajority vote of seven out of nine city council member and requires voter approval of the transfer of parkland interest to any individual or entity not controlled by the city with exceptions for court orders, eminent domain, title disputes or regulations, temporary permits, easements, and de minimis transfers. Another competing charter amendment, Question 2C, designed to require supermajority city council approval but not voter approval was also put on the ballot.

Another competing charter amendment—Question 2B—designed to also require voter approval for parkland transfers was also put on the ballot.
